There is a lot of comment in the media about judges awarding high awards for personal injury claims and insurance companies settling dubious claims to avoid legal costs. But it does not necessarily follow that if consumers suffer an injury in a shop or workers in the workplace that the injured person will receive an award.
It is important that legal advice is taken and listened to before deciding to pursue a case. Losing a Circuit Court case is costly and a High Court case will cost tens of thousands of Euros.
An example of this was a recent case where an employee of a Dunnes Stores branch injured an eye when she accidently brushed against a cardboard box. She claimed she was under work pressure when the accident occurred. She won in the Circuit Court but Dunnes Stores appealed the decision to the High Court. Here the judge took a different view, finding that the employee was not paying sufficient attention to her work and reversed the decision. In this case the employee, having lost the case, would end up paying substantial legal costs.
