Cosmetic Surgery – What Can You Claim For?

When cosmetic surgery goes wrong due to negligence, it may give rise to a medical negligence claim. However, not every unsuccessful result is due to fault, a poor outcome alone is not enough.

Procedures such as botox, lip fillers, breast implants, scar removal, facelifts, and liposuction can sometimes lead to complications or unexpected results.  If you believe something has gone wrong, it is important to act early. Seek medical advice, keep a record of your treatment dates, and document your symptoms and recovery.

Damages

In medical negligence claims, compensation takes into account pain, suffering, and any long-term effects. Expert medical witnesses are often required to assess whether the procedure was carried out correctly and to evaluate its lasting impact.

Court

Choosing the right court is also important. Claims may be brought in the District Court (up to €15,000), Circuit Court (up to €75,000), or High Court (over €75,000). Each has different costs and timelines, with lower courts often resolving cases more quickly. Your solicitor will guide you on the most appropriate court based on your case and potential compensation.
