Accidents Involving Children

Accidents can happen anywhere at home, school, playgrounds, or public places.

If a child is injured:
✔️ Seek medical attention immediately
✔️ Report the accident to the relevant authority
✔️ Gather witness details
✔️ Take photos of the scene and injuries
✔️ Record important details such as time, lighting, and hazards
✔️ Contact a solicitor as soon as possible

In Ireland, children under 18 are considered minors, so legal actions are brought by a parent or guardian on their behalf.  The general rule of two-years in personal injury cases does not apply to minors. They can either wait until they reach the age of 18 (when the two-year period commences) or they can sue via their parent or guardian (where the two-year limitation period applies). Either way the information surrounding the accident needs to be gathered and the time closest to the date of the accident is the best time to do this.

Where there are injuries that may result in long term or ongoing disability, your solicitor will advise you on the procedure, compensation and time involved.

Parents and guardians should be aware of toy safety warnings and recalls. If a child is injured using a toy with known safety risks, this may affect liability in a personal injury claim.
