PERSONAL INJURIES

Child Injured in Ice Rink Leisure Centre

An eight year old boy lost the top of his little finger down to the knuckle on his left hand in a Donegal ice rink accident. As a result of this his left hand finger is 17 mm shorter than his right-hand finger. The boy who was not identified, had a traumatic experience, and now has a permanent disfigurement to his left hand.

The judge adjourned the hearing to facilitate settlement talks  between the operator of the ice rink and the boy’s father. Liability was not an issue and the hearing was to measure only compensation. The judge was asked to rule on an offer from the defendants which included an ‘all-in’ amount to cover legal costs and compensation of €7,500 in damages and €7,500 in damages but declined to approve the figures. The judge refused to rule on the proposed settlement as the offer, in his view,  did not reflect a reasonable settlement. After further negotiations, the judge approved a settlement figure of €24,055 in damages and €8,455 in legal costs.

This case is E.M. (Minor) v R & A Leisure Ltd [2022] IEHC 66.
